Council and the developer are sharing the works and costs of associated with the widening and reconstruction work for Shingler Street, Leongatha fronting the development. Council's conditions for completing a component of the developer's works were as below: "We’ve discussed this within the team and have the following response: • The contribution figure from the developer to Council of $78,230.50 + GST is accepted, to be paid to Council prior to SOC for Stage 1B • The delineation of works as proposed where the developer’s contractor completes subgrade, subbase and kerb is accepted • Council requests that the cement treatment is omitted from the subbase material to be constructed by the developer’s contractor in Shingler Street (cost saving to developer, no change to contribution requested) • Supervision fees and maintenance bond amounts to Council for Stage 1B can be reduced to suit the works actually being delivered by the developer, at the time when they fall due • Subgrade, subbase and kerb work by the developer’s contractor must be complete by the 15th March 2024 so as not to unreasonably delay Council’s contractor • If the developer’s works cannot be completed by the 15th of March, Council reserves the right to renegotiate the delineation of works such that the subgrade, subbase and kerb works may be completed by Council’s contractor and the contribution amount adjusted accordingly • Council grants leave for the developer to commence the portion of Shingler Street and Jacana Boulevard described within this chain of correspondence only, prior to the approvals otherwise required by the relevant permit prior to commencement of any works within Stage 1B. All of the above is subject to the grant of an amended permit for the development which needs to include a new condition to capture the contribution amount to Council to be paid prior to SOC for Stage 1B."
